Service

LevUp Works provides services and experiments, including Missed-Call → Text → Booking, by appointment and through this website. By using the site, booking time, or participating in an experiment, you agree to these Terms.

SMS Program

Some experiments and booking flows use SMS. These texts are transactional, not bulk marketing campaigns.

• Purpose: transactional texts about missed calls, booking links, confirmations, and reminders.
• Frequency: typically one missed-call follow-up plus one or two reminders around an appointment, depending on configuration.
• No cold outreach: the SMS program is not intended for cold outreach or mass promotional campaigns.
• Opt-out: recipients can reply STOP at any time to stop receiving SMS for that flow.
• Help: recipients can reply HELP or email [email protected] for help.
• Rates: message and data rates may apply, depending on the recipient's mobile plan.

Your callers and users (for clients)

If you are a client using the SMS program for your own customers or callers:

• You are responsible for ensuring you have a lawful basis to contact your callers.
• You are responsible for any message content you configure, including compliance with applicable laws and carrier rules.
• You must honor opt-outs from your callers and not attempt to re-add opted-out numbers to SMS flows.

LevUp Works provides the tooling and integrations, but you remain responsible for how you use the SMS program with your callers.

Deliverability and availability

SMS delivery and call handling depend on carriers, networks, and third-party providers. LevUp Works cannot guarantee that every message will be delivered or delivered on time.

The SMS program and booking flows are not designed for emergency use. Do not rely on them for urgent or life-critical communication.

Acceptable use

You agree not to use the SMS program or site to:

• Send unsolicited bulk messages or spam.
• Send messages that are misleading, fraudulent, or illegal.
• Send content that violates telemarketing, privacy, spam, or other applicable laws.
• Interfere with or attempt to disrupt the site, infrastructure, or other users.

LevUp Works may suspend or disable access to the SMS program or related services if there is reasonable evidence of misuse.

User responsibilities

More generally, you agree to:

• Provide accurate information when you book, email, or participate in experiments.
• Use the site and booking system only for lawful purposes.
• Comply with these Terms and any additional written agreements for specific projects.

Third-party services and links

The site and experiments may rely on third-party services such as calendar tools, SMS providers, payment processors, and analytics platforms. Those services are governed by their own terms and privacy policies. LevUp Works is not responsible for third-party sites, services, or their content.

No guarantees of outcomes

Experiments and services are designed to improve real metrics, but results depend on your business, traffic, team, and implementation. LevUp Works does not guarantee any specific increase in revenue, conversion rate, or other outcome.

Intellectual property

The site design, text, graphics, and other content are owned by or licensed to LevUp Works. You may use the site for your own internal business purposes, but you may not copy, resell, or redistribute content as your own without written permission.

Limitation of liability

To the maximum extent permitted by law, LevUp Works is not liable for any indirect, incidental, special, or consequential damages, lost profits, or lost data arising out of or related to your use of the site, SMS program, experiments, or services.

If LevUp Works is found to be liable despite this section, the total liability is limited to the amount you paid LevUp Works for the relevant service in the three (3) months before the event giving rise to the claim.

Termination

LevUp Works may suspend or end your access to the site, experiments, or services at any time if there is misuse, non-payment, or other material issues. You may stop using the site or services at any time. Sections of these Terms that by their nature should survive termination (for example, intellectual property, limitation of liability, and governing law) will continue to apply.

Governing law

These Terms are governed by the laws of the jurisdiction where LevUp Works is established, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless both sides agree in writing to another forum.

Changes

These Terms may be updated from time to time. The “Last updated” date at the top of this page shows the latest version. If you continue to use the site or services after changes take effect, you accept the updated Terms.
